Kota Kinabalu: A 27-year-old man has failed in his appeal against his sentence of 10 years jail and three strokes of the cane for a gang robbery armed with a sickle.
High Court Judge Datuk Maslinda @ Linda Ainal dismissed the appeal by Mohd Hiesyamsuddin Baharudding and upheld the sentence imposed by the Sessions Court.
On Aug 8, 2025, the Sessions Court sentenced Mohd Hiesyamsuddin and his co-accused, Asreen Arskan, 25, to 10 years’ jail and three lashes of the cane after they pleaded guilty to robbing a cashier at a 7-Eleven outlet in Telipok Ria, Tuaran, of RM67 in cash while armed with a sickle at 3.13am, on July 17, 2025.
The charge under Section 395 read together with Section 397 of the Penal Code, carries a jail term of up to 20 years and whipping on conviction.
The duo were ordered to serve the imprisonment sentence from the date of conviction.
In dismissing Hiesyamsuddin’s appeal, Maslinda held that the Sessions Court had taken into account the submissions by the prosecution and the appellant’s mitigation before passing sentence.
The High Court found that, having regard to the seriousness of the offence and in accordance with the law, the sentence imposed by the Sessions Court was appropriate.
Meanwhile, Asreen’s appeal against his sentence had been dealt with separately in another High Court and was struck out.
Hiesyamsuddin was unrepresented while Deputy Public Prosecutor Sofia S Sawayan appeared for the prosecution as respondent.
