14 months and RM5,000 fine for housebreaking

Kota Kinabalu: The Magistrate’s Court here, Friday, sentenced a man to 14 months’ jail and fined him RM5,000 or six months’ jail for housebreaking.

Elnagras Manan pleaded guilty before Magistrate Jessica Ombou Kakayun to breaking into a house at Jalan Kelengkeng, Taman Antarabangsa here, along with two accomplices still at large with the intention to steal at 3.30pm on July 9.

The court heard that tools were also found outside the house.

Unrepresented, Elnagras requested for a lenient sentence on the grounds that he has a father who suffered from high blood pressure and diabetes.

Jessica ordered Elnagras to serve the jail term from the date of his arrest.

Elnagras was charged under Section 451 of the Penal Code read with Section 34 of the same Code.

In another case, an unemployed man was jailed 12 months and fined RM3,000 or three months’ jail for shoplifting.

Tomy Rubin, 31, admitted to stealing five types of merchandise from Mr DIY’s shop at Manggatal Plaza including two units of USB headlamps at 7.40pm on July 19.

The court was informed by the prosecution that Elnagras was found in a suspicious manner while inside the premises before he left.

Elnagras was stopped outside the premises and the items were found in his bag when checked by the shop workers.

Duty counsel Lim Ming Zoong @ Lawrence representing Tomy applied for leniency by saying that he was unemployed.

Elnagras was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years and liability of a fine on conviction.

Inspector Albert Basiri prosecuted.
