
Kota Kinabalu: A 30-year-old woman was sentenced to death by the High Court here for trafficking 3,565.9gm of syabu three years ago.
Nursafa Zakiah Jamaneh was found guilty of committing the offence at 8.28pm on March 1, 2019 at the passenger checking branch at the Arrival Hall of the Kota Kinabalu International Airport here.
Judicial Commissioner Amelati Parnell in her decision on Thursday held that the court found that the prosecution had successfully proven its case beyond reasonable doubt.
Nursafa was found guilty as charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952.
She appeared sad on hearing the court’s decision.
Nursafa, who was represented by assigned counsel Zahir Shah, was the sole defence witness and gave her evidence under oath.
The prosecution conducted by Customs Deputy Public Prosecutor Nur Suriati Mohamad had called 11 witnesses to testify at the prosecution’s stage.
Nursafa had on Oct 4, 2019 claimed trial to the charge under Section 39B(1)(a) of the Dangerous Drugs Act which carries the death sentence or imprisonment for life and whipping not less than 15 strokes if not sentenced to death, on conviction.
In another similar case, a 50-year-old unemployed was tentatively charged with trafficking 54.92gm of syabu.
However, no plea was recorded from Susah Sagimin, who was brought before Court Registrar Rita Kunsoi, after the charge was read out to him.
Susah allegedly committed the offence at 12.30pm on Oct 31, this year in a house at Kg Rakyat Baru, Manggatal.
The court set Dec 13 for mention pending the chemist’s report.
Susah was ordered to be remanded further as the charge against him has no provision for bail.
