
Kota Kinabalu: Four men were freed from a charge of causing grievous hurt to a policeman with an iron, without their defence being called.
Sessions Court Judge Azreena Aziz discharged and acquitted Melvorn Manogaran, 37, Melbert Manogaran, 40, Sazali Eddie, 39 and Jackson Baru, 31, after ruling that the prosecution failed to establish a prima facie case against the four on Friday.
The court made the decision at the end of the prosecution case.
The four were accused of assaulting Constable Mohd Faidz Sali, 38, at 6.30am on Aug 22, 2020 in front of a house in Kg Kionsom, Inanam.
They were charged under Section 326/34 of the Penal Code which provides for a jail term of up to 20 years, and liable to whipping or fine, on conviction.
The prosecution had called several witnesses during the hearing.
Deputy Public Prosecutor (DPP) Siti Hajar Mazlan stood in for DPP Dacia Jan Romanus who appeared for the prosecution while counsel Datuk Bernard J. Dalinting defended the four.
Meanwhile, an illegal immigrant was jailed four months for entering the State illegally.
Hasim Ilak pleaded guilty to entering the State without any identification document at the city area on Nov 18 this year.
The court ordered Hasim to serve the jail sentence from the date of his arrest and was referred to the Immigration Department after serving his jail sentence for his biometrics data to be recorded before deportation.
