Kota Kinabalu: Parti Kerjasama Anak Negeri (Anak Negeri) sought clarification whether the State's constitutional entitlement to 40pc of the net federal revenue accrued in Sabah provided for under Part IV of the Tenth Schedule of the Federal Constitution is still intact, relevant and applicable.
Its President Datuk Henrynus Amin said confusion has arisen due to State Government agreeing to take the offer of RM126 million special grant and this year revised to RM260 million in lieu of the 40pc state's constitutional entitlement on net federal revenue accrued in Sabah.
He said the confusion started with the publication of the Federal Gazette dated April 20, 2022 and the subsequent remark by then Finance Minister Tengku Zafrul Aziz that the new revenue sharing formula between the Sabah and Federal governments will render the 40pc formula inapplicable.
"Since the Chief Minister had said it was only an interim payment, he should be given the benefit of doubt, but it is the right timing for him to clear the apparent confusion once and for all."
“This is the best opportunity for CM to clear doubts by tabling a motion in the State Assembly reiterating his stand on the 40pc entitlement.”
He said the GRS State Government must honour its election promises to protect state rights as enshrined in the IGC Report 1962, the Malaysia Agreement 1963 and the Federal Constitution.
