Kota Kinabalu: Seven Filipino illegal immigrants were jailed by the Magistrate’s Court here for using forged e-boarding passes in an attempt to board a flight to Tawau, at the airport here, last month.
They were John Rhod Arevalo Aguilar, 27, Axel Angala Orconez, 25, Jonnalyn Nano Cagod, 29, Mark Jay Reganit Salcedo, 28, Marck Lester Pangilinan Bumatayo, 32, Genesis Evaristo Miranda, 24, and Darriane Royce Tolentino Licup, 29.
The five pleaded guilty before separate magistrates to fraudulently using as genuine an electronic boarding pass for an AirAsia flight from Kota Kinabalu to Tawau, despite knowing them to be false, on Aug 18, at 2.50pm, at the Domestic Departure Hall, Level 2, Kota Kinabalu International Airport.
John, Axel and Jonnalyn, who appeared before Magistrate Marilyn Kelvin, were jailed eight months each; Mark and Marck, who appeared before Magistrate Wan Farrah Farriza Wan Ghazali, were each handed six months’ jail.
Genesis and Darriane, who were brought before Magistrate Dzul Elmy Yunus, were jailed four months and three months, respectively.
The seven were ordered to serve their sentences from the date of their arrest and be referred to the Immigration Department thereafter.
Earlier, the prosecution in tendering the facts of the case, informed the court that the five had presented the forged boarding passes bearing the booking code GE9SPA to a Malaysia Airlines Berhad auxiliary police officer during document inspection.
The personnel became suspicious of the documents and detained the seven.
Further checks with AirAsia revealed that there were no valid flight records under the details of the seven individuals, and that the booking code provided actually belonged to another passengers.
The Filipinos pleaded for leniency, citing, among other reasons, their difficult living conditions and the fact that they have dependants in their home country.
The prosecution applied a deterrent sentence.
Deputy Public Prosecutor (DPP) Akaash Singh and Inspectors Yusdi Basri and Mohamad Hamidi Mohamad Hamzah prosecuted.
