Kota Kinabalu: Two men were each sentenced to 40 months’ jail and fined RM500 or two weeks jail by the Magistrate’s Court on Tuesday for keeping a stolen luxury vehicle.Shop assistant Sezine Frances, 23, and jobless Rayqal Benjamin, 24, changed their plea to guilty before Magistrate Afiq Agoes to the charge during pre-trial case management (PTCM) of their case on Tuesday. The duo pleaded guilty to keeping a stolen BMW vehicle belonging to one Andy Zulkarnaen at 8.45pm on Aug 25 at a car park at Block P, Jalan Kayu Madang, Telipok in Manggatal.

The charge under Section 411 of the Penal Code carries a jail term of up to five years or fine or both on conviction. The facts of the case stated that the car was reported stolen in Likas on Aug 25 at 8.29am. The duo was arrested by police at 8.45pm on Aug 25 at the said area while trying to sell the car, the court heard. The court ordered Sezine and Rayqal to serve the jail term from the date of their arrest and ordered Rayqal to be referred to the Immigration Department after serving the sentence. Earlier, the duo, who was not represented requested for a lenient sentence. The prosecution applied for a deterrent sentence on the grounds that Sezine had various conviction record while Rayqal has no valid document.

In another case, a 28-year-old man was fined RM3,000 or six months jail for dishonestly concealing someone else’s RM525 in his bank account. Mohd Ameer Mohd Ali pleaded guilty before Magistrate Stephanie Sherron Abbie to removing the money belonging to one Jany Tai. The charge, under Section 424 of the Penal Code, provides an imprisonment for up to five years, or with fine, or both, if found guilty. Counsel Lim Ming Zoong @ Lawrence representing Ameer applied for a lenient sentence on the grounds that he works only as a storekeeper and is remorseful and gave cooperation to police. Meanwhile, the case of a man charged with assaulting his daughter with a helmet, will be mentioned back on Oct 1. The court set the date for Mohd Yusran Mohd Yusof during PTCM on Tuesday. Yusran was on Sept 10 claimed trial to causing his daughter injury to her right shoulder in the living room of a house at Sepanggar Bay in Manggatal on 7.30pm on Sept 8, 2019. He faces a jail term of up to two years or a fine or with whipping or any two of the punishments, if convicted under Section 324 of the Penal Code.
