Man’s sexual assault on minor case set for mention Dec 8

Kota Kinabalu: The case of a 27-year-old man charged with committing sexual assault against a seven-year-old girl had been set for mention on Dec 8.

The Sessions Court fixed the date for Mohamad Rafizan Rushlan, in view of the Conditional Movement Control Order (CMCO) which is still ongoing. 

Mohd Rafizan is accused of committing the offence by kissing the girl at 2.55pm on Dec 6, 2019 at the staircase of Taman Tun Said in Kota Belud.

The offence, under Section 14 (a) of the Sexual Offences Against Children Act 2017, carries a jail term of up to 20 years and whipping, upon conviction.

Mohamad Rafizan is currently detained under Section 259 of the Criminal Procedure pending disposal of the case.

Meanwhile, the trial of a case involving two men charged with two counts of having stolen items had been vacated.

Bobbito Dongkong and Freymickey Hilery Able, both 25, were supposed to stand trial on Nov 23-24, but due to the implementation of CMCO, the trial was vacated.

The new pre-trial case management is on Dec 14 this year.

On the first charge, the duo was accused of having eight stolen batteries at 10.20pm on April 6 this year at a security guard hut, Jalan KKIP, near here.

On the second count, Bobbito and Freymickey allegedly had another eight stolen batteries at the same place and time.

Pending the date, the duo’s bail had been extended.
