Kota Kinabalu: The Election Court will on Dec. 28 deliver its decision on the Preliminary Objections (PO) raised by Sindumin Assemblyman Datuk Dr Yusof Yacob and two others to strike out the election petition filed by the BN candidate to nullify his victory in the Sindumin State seat in the 16th State Election.

High Court Judge Haji Alwi Haji Abdul Wahab on Dec. 7 fixed the date after hearing submissions on the PO via video conferencing.

The petitioner Sani Miasin named Yusof, the returning officer of Sindumin state constituency and the Election Commission of Malaysia as the first, second and third respondent in the election petition.

The second and third respondent also filed their respective preliminary objection to the election petition.

Sani is seeking that Yusof was not duly elected as the assemblyman for the constituency and that it be declared that the said election held on Sept 26 was void.

On Nov 8, Election Court judge Haji Alwi Haji Abdul Wahab ordered all respondents to file in their respective formal notice of POs by way of e-filing and also to file submission on given dates.

 Sani was represented by counsel Rizwandean M Borhan, Mohd Azhier Farhan Arisin, Noor Azah Rahman and Al Hafidz Lokman while the first respondent was represented by counsel Serena Liew.

The second and third respondent were represented by Senior Federal Counsel Andi Razalijaya A Dadi, Nazri Ismail, Mariam Hasanah Othman, Raja Zaizul Faridah Raja Zaharudin and Federal Counsel Istisyhad Ismail of Attorney General’s Chambers.
