20yrs, rotan for raping daughter, 13

Kota Kinabalu: A 54-year-old man who raped his 13-year-old daughter, was ordered to spend 20 years in jail and to get 15 strokes of the cane.

Sessions Court Judge Elsie Primus handed the sentence to the man after he pleaded guilty to the charge against him on Thursday.

The man had raped the girl at 2am on Dec 5, 2020 at a house in Kudat.

He committed the offence under Section 376(3) of the Penal Code which provides for a jail term of between eight and 30 years, and whipping not less than 10 strokes, on conviction.

In his mitigation, the man, who was not represented, asked for leniency saying that he has four children to look after.

However, Deputy Public Prosecutor Mas Izzaty Lokman urged the court to impose a deterrent sentence on the grounds that the man had committed a serious offence.

The court heard that the victim had lodged a police report on Dec 6, 2020 against the man, claiming she was raped by her father. 

The father was later arrested and investigation revealed that the father of the victim entered her room while she was sleeping and raped her.

The girl tried to fight but to no avail. 

Investigation revealed that the man and his wife had divorced and the girl was being looked after by her grandmother but the man always asked her to go back to his house. 

The victim was sent to Likas Hospital and the medical report confirmed that there was old tear in the victim’s private part.
