Kota Kinabalu: The Sessions Court here Tuesday ordered a 37-year-old man to pay a fine of RM5,000 or two months jail for allowing an illegal immigrant to stay in his premises.Arthur Brian Mojugah pleaded guilty before Judge Azreena to allowing the illegal immigrant to stay in the Mai Yai Thai Orchid Restaurant at the Waterfront, Jalan Tun Fuad Stephen on Feb 7, 2020. The offence, under Section 55E(1) of the Immigration Act 1959/63 provides for a fine of between RM5,000 and RM30,000 or a jail term of up to 12 months or both on conviction for each illegal immigrant found at the premises.
Immigration Department officer Zaifee Zaimin prosecuted. In another Sessions Court trial, a 23-year-old man, who has two conviction record of taking syabu, was sentenced to five years and ordered to be caned once for taking the drug for the third time. Mohd Fayz Ahmad pleaded guilty before Judge Ummu Kalthom Abdul Samad to committing the offence at 11.30am on July 24, 2019.
He was charged under Section 39C(1)(b) of the Dangerous Drugs Act (DDA) 1952, which provides for a jail term of between five years and seven years and whipping of not more than three strokes of the cane. The court also ordered Fayz to be placed under police supervision for two years thereafter. Fayz was represented by counsel Mohd Al Hafidz Mohd Lokman, who requested for a lenient sentence be imposed. Deputy Public Prosecutor Nur Syafiqah Suleiman appeared for the prosecution.
