Kota Kinabalu: Suspicions that rapes do occur in detention centres in Sabah holding foreigners were confirmed, Friday.A Federal Special Task Force personnel was jailed 18 years and ordered caned once for raping a Filipina aged 16 at the Temporary Detention Centre in Papar. Sessions Court Judge Azreena Aziz handed the sentence to Abd Kahar Liman, 35, after the court ruled that the prosecution proved its case beyond reasonable doubt against Abd Kahar.
Azreena also ordered Abd Kahar to pay compensation of RM10,000 in default six months’ jail, to the victim. After completing his sentence, Abd Kahar would be placed under police supervision for two years. The court granted Abd Kahar‘ application to stay of execution pending appeal against the decision to the High Court.
Abd Kahar was ordered to pay a new bail of RM10,000 pending the appeal. He was found guilty of raping the girl at midnight in May 2018 at the Post 3 Building at the detention centre in Kimanis. The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction. Abd Kahar was charged on March 20, 2019 at Papar Sessions Court and claimed trial. Six prosecution and two defence witnesses were called during the hearing. Deputy Public Prosecutor Nureen Natasha Mohd Raffie conducted the prosecution while counsel Luke Ressa Balang defended Abd Kahar.
