Man gets jail, rotan for hurting woman while robbing her

Kota Kinabalu: A 28-year-old man was sentenced to five years and ordered to get two strokes of the cane for causing hurt to a woman while robbing her.

Mohd Hidayat Hashim, pleaded guilty before Sessions Court Judge Egusra Ali, to the charge against him on Monday.

He assaulted one Zuraini Zulkifle Lee, 21 while robbing her of her handphone at 4.10am on Oct 14, 2020 in a house in Sek 3 at Kg Sungai Labu in Labuan.

The offence under Section 394 of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

The court ordered Mohd Hidayat to serve the jail sentence from the date of his arrest.

During mitigation, Mohd Hidayat who was not represented asked for a lenient sentence by saying that he needed to look after his 11-year-old daughter and parents who are suffering from heart problem and kidney failure.

He told the court that he committed the offence because he was desperate as he has no job due to the Movement Control Order (MCO). 

However, Deputy Public Prosecutor Adibah Saiful Bahri urged the court to impose a deterrent sentence on the grounds that the victim suffered physical injury and became traumatised because of the incident.

Adibah submitted that during the incident, Mohd Hidayat threatened the victim with a knife.

The court heard that the incident happened while the victim was sleeping in her rented room when an unknown man entered the room, kicked her, slapped her face and threatened her with a knife so that she surrender all her valuable things.

Investigation revealed that during the incident, the victim was alone in the room and that the man, later identified as Mohd Hidayat, also covered her mouth.

Mohd Hidayat fled the scene with the victim’s handphone and cash.

Following the police report, Mohd Hidayat was arrested.

In another court, a 44-year-old security guard was charged with raping his step-daughter, will go on trial on June 14–15 this year.

The man maintained his plea of not guilty.

He is accused of raping the 17-year-old girl at 7am on Apr 20, 2020 in a house in Labuan.

The prosecution will call about seven to eight witnesses in the hearing.
