Kota Kinabalu: A 29-year-old woman was jailed five years and fined RM10,000 or another 12 months for committing criminal breach of trust (CBT) involving a sum of RM664,870.Sessions Court Judge Elsie Primus handed the sentence to Noor Rawiada Mohamad Salleh after she pleaded guilty. Noor Rawiada had breached the trust given to her as assistant clerk at the Wisma Perindustrian premises, here, between April 3 and Dec 20, 2019.
Noor Rawiada, who was entrusted to handle a RHB Bank account belonging to the company, had transferred the money by conducting 48 online transfers to her RHB account for personal use. The charge, under Section 408 of the Penal Code, carries a jail term of between a year and 14 years and whipping or fine, upon conviction. The court ordered Noor Rawiada to serve the jail sentence from the date of her conviction. Meanwhile, an entertainment outlet caretaker was fined RM3,000 or six months jail by the Magistrate’s Court, here, for operating the premises beyond the permitted time two years ago. Roslan Awang, 36, pleaded guilty to operating the Club Mix R&B Pub, at Block 31, ground floor, Koidupan, Penampang at 2.36am on Nov 18, 2019 beyond the permitted time.
Magistrate Lovely Natasha Charles was informed by the prosecution that a police team went to the premises and found it still operating beyond 2am. The police seized music equipment in the presence of Roslan for breaching the condition of the licence. Roslan had committed an offence under Section 4(1) of the Public Entertainment Ordinance 1958 which is punishable under Section 11 of same Ordinance that provides for a fine of up to RM5,000 or up to one year or both, upon conviction. In another case, a 24-year-old man was fined RM900 or two months jail for having illegal gambling paraphernalia. Mohd Mirzan Jaffry admitted to having three slips of illegal lottery tickets at 4.05pm on Feb 26, 2020 at the five-foot-way of Putatan market.
The court heard that Mirzan was detained by a police team who found him selling lottery illegal and also seized RM98 cash from him. Mirzan was charged under Section 9(1) of the Common Gaming House Act carries a jail term of up to six months, or fine of up to RM3,000, or both, upon conviction. The court ordered the seized money to be forfeited. Inspector Kelvan Elson Maik prosecuted.
