Kota Kinabalu: A 38-year-old woman was freed from a charge of committing breach of trust involving a sum of RM14,663.10.

Sessions Court Judge Noor Hafizah Mohd Salim discharged and acquitted Sham Sze Yeun without her defence being called.

The court ruled that the prosecution had failed to establish a prima facie case against Sham.

Sham was accused of breaching the trust given to her as assistant manager of Syarikat Vinz Sdn Bhd which entrusted her with the daily cash sales belonging to the company but took the money for herself.

The offence allegedly took place between Aug 10 and Sept 6, 2018 at the company’s premises at KK Times Square, here.

The offence under Section 408 of the Penal Code provides for a jail term of between one and 14 years, and whipping, upon conviction.

The court ordered the bail offered to Sham to be refunded to her.

The prosecution had called six witnesses in the hearing.

Deputy Public Prosecutor Megat Mahathir Megat Tharih Affendy conducted the prosecution while counsel Mohd Syazwan Shah Mohd Ali defended Sham.
