Youth gets jail, cane for carrying weapons in public without permit

Kota Kinabalu: A 22-year-old was jailed five years and given a stroke of the cane for having weapons in public place without permit.

Sessions Court Judge Elsie Primus meted out the sentence to Nazmie Mak Hon Kit who pleaded guilty to the charge against him on Monday.

Nazmie was found having a pair of scissors and a dagger at 9.30am on May 4 this year at the road entrance to Pitas Hospital.

The offence under Section 6(1)(a) of the Corrosive, Explosive and Dangerous Weapon Act 1958 carries a jail term of between five and10 years, and whipping, on conviction.

During mitigation, Nazmie who was not represented, asked for leniency saying that he has a mother and three siblings to look after.

According to Nazmie, he was working as a salesman in Kuala Lumpur previously and that in November last year, he returned to Sabah and never went back to the nation’s capital again.

However, Deputy Public Prosecutor Rustam Sanip urged the court to impose an appropriate sentence and asked for the exhibits to be forfeited.

The court heard that during the incident, Nazmie who was riding his motorcycle, was stopped by a police patrol in the area and that upon inspection, the police found the weapon in the pocket of his trousers.

When asked by the police regarding the weapons, Nazmie could not give a satisfactory explanation why he is carrying the weapons.

Nazmie was subsequently arrested and taken to the police station with the weapons. Further investigation showed that Nazmie has no permit to carry the weapon in public.
