Raping stepdaughter: Man’s guilty plea is rejected

Kota Kinabalu: A man who was charged with raping his stepdaughter will have his case mentioned again on Sept 30.

Sessions Court Judge Elsie Primus set the date for the man, whose case came up for facts and sentencing before her.

The court rejected the man’s guilty plea as the judge was not convinced that he knew what he was pleading to and told him that the court would write to the National Legal Aid Foundation (YBGK) for a lawyer to advise him.

The man, who had previously pleaded guilty to the charge, sounds uncertain about what he was pleading to when asked by the court about his plea.

The prosecution applied for another mention date.

The man was accused of raping his 10-year-old stepdaughter at 3am on April 23, this year in a village in Kota Marudu.

The charge under Section 376(3) of the Penal Code carries a jail term of between eight years and 30 years and whipping of not less than 10 strokes, on conviction.

Deputy Public Prosecutors (DPP) Mas Izzaty Lokman and Mohammad Fauzi Acho prosecuted.

The accused was not represented.

In another case, seven people were penalised for committing drug-related offences.

Four of them Azlameer, Mohamad Narawis, Sazlina Munil and Razalan Ooi pleaded guilty before Magistrate Stephanie Sherron Abbie to having syabu, respectively.

Azlameer was fined RM4,500 or 10 months jail, Mohamad was fined RM3,500 or eight months jail while Sazlina and Razalan were jailed seven months each.

Meanwhile, Razalan, Ezlan Erwan, Sufian Biran and Abi Masirip admitted to taking syabu between April 6 and July 13.

They were each handed six months jail.
