Drug trafficking: Eight, including 14-year-old, charged

Kota Kinabalu: Eight men were charged at the Magistrate’s Court here with drug trafficking.

Six of them, Mohd Azif Awang, Nurhim Usman, Benji Abdul, Al Kiram Abdul Musa and a 14-year-old were accused of trafficking 87.21gm of MDMA at 10am on Oct 7 at the living room of Pool Villa Karambunai.

The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes, upon conviction.

No plea was recorded from them, who appeared via video conferencing before Magistrate Stephanie Sherron Abbie.

Inspector Suzie @ Stephanie Kupit applied for a new mention date pending the chemist’s report.

Counsel Hairul V. Othman representing Azif, Al Kiram and the boy, applied for a dental check up on the boy as he was informed by his family that he was under 12 years old age.

The court fixed Nov 30 for mention pending the chemist’s report and also to produce the boy’s dental report.

Meanwhile, Indonesian Thomas Sabon Mehen, 35, who appeared before Magistrate Lovely Natasha Charles, was accused of trafficking 65.34gm of syabu at a parking area in front of the Upperstar Café, Manggatal Plaza at 2pm on Oct 11.

No plea was taken from Thomas.

Thomas was also charged with another count of having 1.08gm of syabu at the same place and time and taking syabu and amphetamine at 9.30pm on the same day.

Inspector Kelvan Elson Maik, prosecuting, applied for another mention date pending the chemist’s reports and offered no bail as the charge against Thomas has no provision for bail.

Lovely set Nov 30 for mention and ordered Thomas, who was not represented, to be remanded further.

A Filipino Sedri Sara, 25, allegedly trafficking 50.05gm of syabu at 2.30pm on Oct 10 at a roadside of Telipok Settlement scheme in Manggatal.

No plea was taken from Sedri, an unemployed, after the charge was read out to him before Magistrate Jessica Ombou Kakayun virtually.

The court fixed Nov 24 for mention pending the chemist’s report.

In another case, a man was jailed three weeks for having properties believed to be stolen.

Mohd Shamrin Baharudin admitted before Magistrate Lovely to having six types of various machines which he failed to give satisfactorily explanation on how he obtained them. 

Shamrin had committed an offence under Section 22A (1) of the Minor Offences Ordinance which provides for a fine of up to RM100 or up to three months jail or both, on conviction.

He requested leniency while Kelvan applied for an adequate sentence.
