
Kota Kinabalu: Three local men claimed trial at the High Court, here, to trafficking 495.2gm of cannabis.
Annuar Azmi, 24, Hasrani Aliamid, 23, and Mahadan Majid, 24, pleaded not guilty before Judge Datuk Nurchaya Hj Arshad to committing the offence at 9.25am on May 15, 2020 in front of the East KKIP Poslaju office, Manggatal.
The trio was jointly charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952.
The charge is punishable under Section 39B (2) of the same Act which carries the death penalty or imprisonment for life and whipping not less than 15 strokes if not sentenced to death, on conviction.
Deputy Public Prosecutor Rozanna Abd Hadi applied for pre-trial case management (PTCM) date.
The court fixed Dec 3 for the first PTCM and ordered the trio to be further remanded pending the date as the charge against them has no provision for bail.
They were represented by counsel PJ Perira.
Meanwhile, a 20-year-old woman was fined RM800 or 14 days jail for engaging in online gambling using a handphone.
Hizriyatul Peter admitted before Magistrate Jessica Ombou Kakayun to committing the offence at 4.26pm on Sept 5 at a cafe in Asia City.
The charge under Section 7(1) of the Common Gaming Houses Act 1953 provides for a fine of up to RM5,000 or up to six months or both, on conviction.
Inspector Albert Basiri, prosecuting told the court that Hizriyatul was arrested while she was dealing business with the public.
Hizriyatul’s handphone was later found to contain an online gambling application and RM270 cash were then seized from her.
In mitigation, Hizriyatul requested a lower fine and said she was remorseful and will not commit similar offence in the future.
The court ordered the seized money to be forfeited.
