
Kota Kinabalu: A 37-year-old man from Selangor was freed without his defence being called from a charge of insulting the modesty of PKR Vice-President Mohd Rafizi Ramli.
Sessions Court Judge Marlina Ibrahim discharged and acquitted Daing Muhammad Reduan Bachok, who was PKR Lembah Jaya constituency coordinator, after ruling that the prosecution had failed to establish a prima facie case against Daing.
Daing was accused of committing the offence against 44-year-old Rafizi at 4pm on Nov 3, 2018 at the Kospen Community Centre in Kg Merampong, Keningau.
The charge stated that Daing had uttered profanities which could be heard by others.
He was charged under Section 509 of the Penal Code which provides for a jail term of up to five years, or fine, or both, on conviction.
The prosecution had called eight witnesses during the hearing which started on Sept 14, 2020.
Deputy Public Prosecutor Nur Faezah Jafry conducted the prosecution while counsel Amli Nohin defended Daing.
