Lorry driver gets jail and rotan over RM6,500 CBT

Kota Kinabalu: A 39-year-old lorry driver was jailed three years and ordered to get a stroke of the cane for committing Criminal Breach of Trust (CBT) involving water tanks valued at RM6,500.

Sessions Court Judge Azreena Aziz meted out the sentence to Bonny Egoh, who changed his plea to guilty during the pre-trial case management on Thursday.

Bonny was entrusted with four blue water tanks TH300, five blue water tanks TH401 and three spiral culverts by the Syarikat Kinabalu Transport KKIP Manggatal but had breached the trust given to him as the lorry driver, for his own use.

The offence took place between Sept 1 and Nov 22, 2021 at Syarikat Kinabalu Transport KKIP Manggatal, near here.

The offence under Section 407 of the Penal Code carries a jail term of between one year and 10 years, and with whipping or fine, on conviction.

The court ordered Bonny to serve the jail sentence from the date of his arrest.

During mitigation, Bonny, who was not represented, asked for leniency and the sentence to be served from the date of his arrest.

He informed the court that he has a father to look after.

However, Deputy Public Prosecutor Adibah Saiful Bahri urged the court to impose a deterrent sentence as Bonny had breached the trust given to him.

The court heard that Syarikat Kinabalu Transport KKIP Manggatal was appointed by Syarikat Tomher to deliver items to its (Syarikat Tomher) customers in Keningau.

On Sept 1, 2021, Bonny was ordered by his company manager to deliver four blue water tanks TH300 from the Tomher Industrial Sdn Bhd factory to Huang Lee Alat Binaan in Keningau and on Sept 4, 2021 he was ordered to deliver five blue water tanks TH401 and three spiral culverts from the same factory to Sunglight Timber Hardware in Keningau.

However, all the water tanks and culvert failed to be delivered by Bonny and the matter came to light when the customers complained to Tomher Industrial as they did not receive the items valued at RM6,500.
