RM1,500 poorer for beating wife over faulty toilet

Kota Kinabalu: An unemployed 45-year-old man, who assaulted his wife over a toilet flushing problem last year, was fined RM1,500 or five months jail on Wednesday.

Teh Beng Chee was ordered to pay the fine after he pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to his 42-year-old wife at 6pm on April 26, 2021 in a unit at Beverly Hills, Penampang.

Inspector Kelvan Elson Maik, prosecuting informed the court that prior to the incident, the wife, who had just returned from work, asked for Beng’s help fixing the toilet flush as it could not flush after she used it.

Teh managed to fix it and in an angry mood, he lifted the toilet tank cover and tried to throw it at his wife but their daughter managed to block him.

When Teh’s wife and daughter moved to the kitchen area, Teh took a steel jug from a table and threw it at his wife and hit her right arm, the court heard.

The wife, who suffered bruises on her arm, then lodged a police report against Teh, said the prosecution.

Duty counsel Lim Ming Zoong, representing Teh in requesting a lenient sentence, told the court that Teh was unemployed since the MCO started and married with two children.

To a question by the court, Teh said the complainant is still his wife but they live apart.

Teh was charged under Section 323 of the Penal Code, which carries a jail term of up to a year or fine of up to RM2,000 or both on conviction.

Meanwhile, a 22-year-old man was fined RM100 or three months jail for fraudulently having RM1, 300 in his bank account, last year.

Kedy Ak Daun pleaded guilty to having the money belonging to one Hasbullah Abdul Him, in his bank account, between Jan 13 and Jan 14, 2021 here, which he failed to give a satisfactory explanation on how he obtained it.

Kedy had committed an offence under Section 22A (1) of the Minor Offences Ordinance which provides for a fine of up to RM100 or up to three months jail or both on conviction.

In another case, a 30-year-old man was fined RM25 or three days jail for threatening his younger sister.

Callixtus Stephen admitted to committing the offence to one Christie Stephen at 9.30pm on Sept 30, 2021 at Kg Rugading Babagon in Penampang.

The court heard from the prosecution that Callixtus uttered “Ko tunggu tiada orang dirumah, hancur kepala ko, hilang kepala ko (Wait (when) no one else at home, your head will break, your head will be gone”).

Kelvan said Callixtus acted in such a way because he was not satisfied with the sister for borrowing their mother’s vehicle to transport her goods from her rented house to their parents’ house. The offence under Section 8(1)(e) of the Minor Offences Ordinance provides for RM25 fine on conviction.
