Molesting daughter: Man is given DNAA after wife withdraws report

Kota Kinabalu: A man was given discharge not amounting to an acquittal (DNAA) from sexually harassing his 14-year-old daughter.

Sessions Court Judge Ummu Khaltom Abdul Samad gave the DNAA to the man when the prosecution received

instruction not to proceed with the case after the complainants withdraw the police report.

The prosecution informed the court that the complainant was the man’s wife who just gave birth and decided not to proceed with the case.

The man was accused of committing the offence against his daughter by

sucking and fondling her breasts as well as touching her private parts at 12.50am on Oct 17, 2021 in a rented house in Ranau.

The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.

Deputy Public Prosecutor Nidzam Ahamd appeared for the prosecution.

Meanwhile, in another court, two men were jailed five months each for entering the State illegally.

Habirudin and Hamdan pleaded guilty separately before Sessions Court Judge Elsie Primus, to the charge against them.

Habirudin was also handed a stroke of the cane while Hamdan was spared from whipping as he was 21-year-old.

The foreigners were arrested on Dec 22, 2021 by the Malaysia Maritime Enforcement Agency after failing to produce identity document.

After completing their jail sentence, the court ordered the foreigners to be referred to the Immigration Department.
