
Kota Kinabalu: A 29-year-old man was ordered to enter his defence on a charge of committing physical harassment against a minor.
Sessions Court Judge Elsie made the order for Mohamad Rafizan Rushlan after ruling that the prosecution had established a prima facie case against Mohamad on Monday. The court set Feb 10 for Mohamad’s defence.
Mohamad is accused of committing the offence against the seven-year-old girl by biting on her back and caressing her private part at 2.55pm on Dec 6, 2019 at a staircase in Taman Tun Said, Kota Belud.
The offence under Section 14 of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.
The prosecution had called five witnesses during the hearing.
Deputy Public Prosecutor Mas Izzaty Lokman conducted the prosecution while Mohamad was not represented.
In another case, two men were jailed five years each for taking drug repeatedly.
Zakaria @ Sawal Botoi @ Botui, 52, pleaded guilty to taking the drug on Oct 12, 2021 after his urine was tested positive for drug at the Beaufort police station.
Meanwhile, Sardu Bin Tahir, 36, was also handed a stroke of the cane and he was found taking the drug on July 6, 2021 when his urine was tested positive for drug at the Beaufort police station.
After completing thier jail sentence, the court ordered them to be placed under police supervision for three years.
