Woman fined RM1.5k over unregistered health products

Kota Kinabalu: A 49-year-old woman was fined RM1,500 for having unregistered products.

Sessions Court Judge Noor Hafizah Mohd Salim handed down the sentence to Sharipah Jauharia Sarip Asadi, who pleaded guilty to the charge against her on Monday.

Sharipah was found having nine types of unregistered products at 12.10pm on Sept 11, 2019 at the Alief Trading in Goshen town, Kota Marudu and at 12.25pm on March 24, 2021 at the Ariah Beauty Care in Bataras Hypermarket, Jalan Tuaran Kolombong, Inanam.

Among the products were Catuaba, Kunyit Hitam, Surut Ayu, Freshcare Strong, Freshcare Greentea, Freshcare Lavender, Freshcare Sports, Freshcare Splash Fruity and Freshcare Sandalwood.

The offence under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 carries a jail term of up to three years, or a fine of up to RM50,000 or both, on conviction.

In mitigation, Sharipah who was not represented, asked for leniency saying that it was her first offence.

The prosecution urged the court to impose an appropriate sentence as Sharipah had committed the offence which could risk the public’s health as the products were not registered with the Health Ministry.
