
Kota Kinabalu: A 30-year-old rubber tapper was jailed 24 months jail, fined RM4,000 or another six months jail and ordered given four lashes of the cane for cheating.
Arron Avel pleaded guilty before Senior Assistant Registrar Abdurrahman Abrar Jarni, who sat as a magistrate, to cheating handphone promoter, Mohd Hazrunnyzam Nasir, into giving him two smartphones at the roadside of Jalan Tuaran Bypass near a petrol kiosk in Tebobon on Aug 17, last year.
The court heard that Arron tricked the promoter through WhatApps by asking him to send the gadgets to his worker at the fuel kiosk.
A copy of the payment slip for RM2,800 was later sent to the complainant by Arron which prompted the latter to give the gadgets to the worker.
However, the payment slip was later found to be fake and a police report was lodged against Arron.
Arron was charged under Section 420 of the Penal Code which provides for a jail term of between one and 10 years, and whipping and fine, on conviction.
Duty counsel Lim Ming Zoong @ Lawrence applied for a lenient sentence.
In another case, a 25-year-old man was fined RM400 or two months jail on Thursday for tearing up a compound notice issued to him for defying the Conditional Movement Control Order (CMCO) last year for gathering in a rented room for a drinking session.
Jayhrey Sikodol pleaded guilty to misbehaving at the Inanam Police Station at 9.37pm on June 6, 2021.
Inspector Albert Basiri told the court that prior to the incident, a police team went to a rented room at Inanam Business Centre following a tip-off on people defying the CMCO and found four men, including Jayhrey, gathering for a drinking session.
The police told them their offence and told them to go to Inanam police station for the issuance of the compound notice, the court heard.
While at the police station, Jayhrey, asked the police about the fine that he should pay and later was seen tearing up the notice while leaving the station.
Jayhrey had committed an offence under Section 90 of the Police Act which provides for a fine of up to RM500 or up to six months jail or both, on conviction.
Jayhrey admitted his mistake and regretted his action and applied for a lower fine.
