
Kota Kinabalu: A 30-year-old woman was fined a total of RM6,500 for selling products containing poisons without licence, unregistered products and cosmetics without labels.
Alice Chong pleaded guilty before Sessions Court Judge Ummu Khaltom Abdul Samad, to the three charges against Chong, on Monday.
On the first count, Chong was fined RM1,500 in default six month’s jail for having for sale 12 products containing poison in which she had no licence to sell, at 12.25pm on March 24, 2021 at the Premis Zynia Cosmetic at the Ground Floor of Bataras Mall in Kolombong, Inanam.
The charges stated among the poisons detected in the products were Tadalafil, Sibutramine and Hydroquinone which are listed in the First Schedule of the Poisons Act 1952.
The offence under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act carries a fine of up to RM3,000, or a jail term of up to a year, or both, upon conviction.
On the second count, Chong was ordered to pay a fine of RM2,500 or spend eight months in jail for having four unregistered products namely, two bottles of Vimax, one bottle of Bazooka, one box of Minyak Lintah, and eight boxes of Minyak Herba Asma Mujarab.
On the third count, Chong was fined another RM2,500 or eight months’ jail for having for sale four cosmetics without labels.
The offences took place at the same place and time.
The court did not granted Chong’s application to pay the fine by instalment but ordered her to pay RM3,000 on Monday and the balance to be settled before March 22 this year.
Prosecuting Officer Lim Lay Ping from the Pharmacy Department appeared for the prosecution while Chong was not represented.
