
Kota Kinabalu: A 21-year-old woman was fined RM2,000 or one-month jail for selling sex stimulant product containing poison without licence.
Sessions Court Judge Elsie Primus handed the sentence to Ellyesther Jonis who pleaded guilty to the charge on Monday.
Ellyesther was found having for sale 12 pieces of Soloco containing Tadalafil, which are listed in the First Schedule of the Poisons Act 1952, without permit.
The offence took place on March 24, 2021 at 12.25pm at the Zynia Cosmetic in Bataras Mall, Jalan Tuaran Kolombong, Inanam.
The offence, under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act, carries a fine of up to RM3,000, or a jail term of up to a year, or both, upon conviction.
During mitigation, Ellyesther asked for leniency saying that she was only a worker at the shop with a salary RM750 per month.
However, Prosecuting Officer Lim Lay Peng from the Pharmacy Department, urged the court to impose an appropriate sentence on the grounds that the sex stimulant product containing poison sold by individuals who have no knowledge in the medical field can harm consumers.
Lim said this is because the use of poisons needs supervision by a medical expert, especially sex stimulant products that could lead to heart attack.
