
Kota Kinabalu: Any enforcement action against Malaysia is bound to fail as we were never subject to the Arbitrator’s jurisdiction in the so-called Sultan of Sulu issuing a default judgement against the country, according to a lawyer familiar with arbitration.
According to Tengku Datuk Ahmad Fuad, the Malaysian Government is immune from legal and arbitration actions, citing a ruling by High Court Judge Datuk Martin Idang in the Kota Kinabalu High Court on March 17, 2020.
