Kota Kinabalu: A man was jailed 10 years and ordered given 10 strokes of the cane for having 33.08gm of syabu.
Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to Adzlan Jumaani Tahaya who changed his plea and admitted to the charge.
Adzlan was found having the drugs at 11.30am on Jan 26, 2021 inside a chicken coop in front of a house at Kg Lok Baru, Pulau Gaya, here. The offence under Section 12(2) of the Dangerous Drugs Act and punishable under Section 39A(2) of the same Act provides for life imprisonment or not less than five years and whipping of not less than 10 strokes, on conviction.
In handing down the sentence, the court had considered of the offence, weight of the drugs and public interest. The court ordered Adzlan to serve the jail sentence from the date of his arrest on Jan 26, 2021.
During mitigation, Adzlan, who was not represented, asked for leniency.
But, Deputy Public Prosecutor Nur Faezah Jaffry urged the court to impose a deterrent sentence. The court heard that based on information, the police went to Adzlan’s house and found the drugs in the chicken coop.
