Raping girl, 17: Two men discharged

Kota Kinabalu: Two men, charged with gang-raping a 17-year-old girl, were discharged not amounting to an acquittal (DNAA).

Sessions Court Judge Azreena Aziz gave the DNAA to Mohammad Gerseyrey Abd Mulok, 29, and Mohd Dzulhilmy Ibrahim, 33, after three times reviewing the warrant of arrest against them but the warrant could not be executed.

The court was informed that the police still cannot locate both the accused.

The court had issued the arrest warrant against the duo, released on bail, when they failed to turn up in court.

Mohammad Gerseyrey and Mohd Dzulhimmy allegedly raped the girl together with two others who were previously found guilty and sent to prison, at a lodging house in Beaufort between 11pm on Sept 4 and 6am on Sept 5, 2017.

The offence, under Section 375B of the Penal Code, carries a jail term of between 10 years and 30 years, and whipping, on conviction.

Mohammad Gerseyrey and Mohd Dzulhimmy were released on a bail of RM10,000 with RM5,000 deposited in two local sureties.

In the same court, a man was jailed four months for entering the State illegally.

Al Kahizel Lokman admitted to entering the State without any document.

He was arrested by the police at the city area after failing to produce his identification document.

The court ordered Al Kahizel to serve the jail sentence from the date of his arrest.

After completing his jail sentence, he was ordered referred to the Immigration Department for deportation.
