Toddler's fatal fall case: Building management pleads not guilty to negligence charge

Kota Kinabalu: A company which managed a building where a toddler fatally fell from the 5th floor through a gap almost three years ago pleaded not guilty to a charge of negligence towards public safety today.

WTW Property Services (Sabah) Sdn Bhd, through its director, pleaded not guilty before Sessions Court Judge Azreena Aziz.

The charge stated that the company as the building management had failed to close the gap securely in the connecting route between Block D and Blocks A, B and C to prevent the risk of people from falling.

The offence allegedly took place at 3pm on Dec 1, 2019 at the proposed commercial development site of T1 Bundusan at Jalan Bundusan, Penampang.

The company was charged under Section 10 (e) the Factories and Machinery Act 1967 and punishable under section 51 (2) of the same Act which provides for a fine of up to RM50,000, or a jail term of up to one year, or both.

The court set May 19 for case management and Feb 1-2 next year for hearing.
