Kota Kinabalu: A Filipino construction worker was charged at the Magistrate’s Court here, Tuesday, with murdering his wife in the city centre last month.
Nul Sadam Jems, 31, who holds an IMM13, is accused of committing the crime against one Nasfidah Japarah, 22, between 10.40pm and 11.47pm on March 22 in a rented room, on the third floor, Block J, Segama.
No plea was taken from Sadam as the case is under the jurisdiction of the High Court.
Inspector Suzie @ Stephanie Kupit, prosecuting, applied for a new mention date pending all related documents.
Magistrate Stephanie Sherron Abbie, who heard the case via video conferencing, set June 13 for mention and ordered Sadam, who was not represented, to be remanded further as the charge against him has no provision for bail.
The charge, under Section 302 of the Penal Code, carries the death penalty on conviction.
In another case, a 27-year-old man was charged with dishonestly misappropriating of RM10,000.
Mohd Hilfian Kamit allegedly misappropriated the money, which belonged to Hong Leong Bank, in his capacity as a cashier of the Safeguards Gas (Sabah) Sdn Bhd, for his own use between March 25 and March 26 this year at the company office at Damai Point Commercial Centre here.
The charge, under Section 403 of the Penal Code, carries a jail term of between six months and five years and whipping and liability of a fine on conviction.
No plea was recorded from Hilfian, whose case was heard via zoom.
The prosecution, in applying for mention date, proposed bail at RM6,000 in two sureties, while Hilfian, who was not represented, applied for a lower bail amount on the grounds that he was unemployed and taking care of his family.
The court set April 11 for mention and released Hilfian on a bail of RM2,000 in two sureties.
Meanwhile, two unemployed people were sentenced to two months’ jail for shoplifting.
Azizi Akmad, 35, and Shazlina Saili, 23, pleaded guilty separately to stealing three cans of Ghee at the Servay supermarket in Putatan at 7.01pm and at 7.03pm, respectively on March 17.
The court heard from the prosecution that a police report lodged by the employee of the supermarket stated that several cans of the clarified butter were stolen by two individuals whose act was captured in the video surveillance footage and that the loss was estimated at RM1,000.
Police investigations revealed that the duo had been active in stealing activities at the supermarket since last year where they entered the premises twice a day, said the prosecution.
Duty counsel Lim Ming Zoong, representing the duo, applied for lenient sentence and told the court that they committed the offence as they have no income and intended to sell the ghee.
Azizi and Shazlina were charged under Section 379 of the Penal Code which carries a jail term of up to seven years or fine or both on conviction.
