Misappropriating RM66,000: Sales executive freed from charge

Kota Kinabalu: A 31-year-old sales executive was freed from a charge of dishonestly misappropriating 386 gas cylinders worth RM66,932.40 without his defence being called.

Magistrate Kasyfurrahman Abang Ahmad discharged and acquitted Wong Ming Teck after ruling that the prosecution had failed to establish a prima facie case against Wong.

Wong was accused of misappropriating the cylinder gas for his own use at 10am on May 25, 2019 at the Syarikat Borneo Kontena in Sipitang.

The charge stated that the gas cylinders belonged to Syarikat Borneo Kontena.

The offence, under Section 403 of the Penal Code, carries a jail term of between six months and five years and whipping and liability of a fine on conviction.

The prosecution had called four witnesses during the hearing.

Assistant Superintendent of Police Hasnan Abidin conducted the prosecution while counsel Sylyester Kuan defended Wong.
