Penampang shopping mall toddler fatal fall: Firm, contractor fined RM35k for negligence

Kota Kinabalu: A company and a building contractor were fined a total of RM35,000 for negligence towards public safety following a toddler's fatal fall through a gap from the fifth floor of the T1 Bundusan shopping mall in Penampang almost three years ago.

Sessions Court Judge Elsie Primus ordered TBMC Development Sdn Bhd to pay a fine of RM20,000 in default a warrant to levy to be issued to the company after its representative pleaded guilty to the charge on Friday.

Meanwhile, contractor Albert Voo Chun Chung, 37, was fined RM15,000 or two months’ jail after he admitted to the offence before Sessions Court Judge Noor Hafizah Mohd Salim.

The charge stated that the company as the owner of the building and Voo as the contractor had failed to close the gap securely on the connecting route between Block D and Blocks A, B and C of the shopping mall to prevent the risk of people falling.

The incident, which drew huge public outcry, took place at 3pm on Dec 1, 2019.
