
Kota Kinabalu: A 61-year-old security guard was charged in the Sessions Court, here, Wednesday, with raping a nine-year-old girl.
Liwoh Tigoan pleaded not guilty before Judge Noor Hafizah Mohd Salim.
He is accused of raping the girl in the evening of May 3 at a house in Jalan Kionsom in Pekan Inanam Baru, here.
The offence under Section 376(2)(e) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction.
The court set June 16 for mention and ordered Liwoh to be remanded pending the date.
The court was informed that the medical and DNA reports are not ready yet.
Deputy Public Prosecutor (DPP) Nur Faezah Jafry appeared for the prosecution while Liwoh was not represented.
In another case, a 44-year-old farmer, Anik Monsion, was given a discharge not amounting to an acquittal (DNAA) from a charge of causing grievous hurt to his wife.
Sessions Court Judge Ummu Khaltom Abd Samad made the order following the request from the prosecution.
Anik allegedly committed the offence against his 38-year-old wife with a bottle of warm liquid.
The offence allegedly took place at a house in Kg Matupang, Ranau on Sept 29, 2021.
The offence under Section 324 of the Penal Code and punishable under Section 326A of the same Code which provides for a jail term of up to 20 years, and whipping, on conviction.
DPP Nurul Shafeerah Mad Iskim stood in for DPP Nidzam Ahmad prosecuted.
