Captain Mohamad Halim Ahmed, the director-general of Malaysia’s Marine Department (JLM), had previously appeared in the Sessions Court to face charges of deception. The allegations involved his role in allowing shipping companies to import heavy-grade oil into Malaysian waters without the necessary approval from the transport minister, a breach that reportedly occurred four years ago.
Anthony Loke, Malaysia’s Transport Minister, announced on August 06, 2024 that Captain Mohamad Halim Ahmed, the director-general of the Marine Department (JLM), has been placed on "gardening leave" following his recent indictment for fraud. This decision aligns with standard civil service procedures while Halim faces legal proceedings.
According to Loke, the suspension ensures that Halim will not be fulfilling his duties during the course of his trial. The minister emphasized that this measure is in accordance with protocol, aimed at maintaining the integrity of the office and the ongoing judicial process.
Captain Mohamad Halim, 57, was charged in the Sessions Court last week with cheating. The allegations involve his role in authorizing the import of heavy-grade oil into Malaysian waters without the requisite approval from the transport minister, an infraction that allegedly occurred four years ago.
The charge against Halim falls under Section 417 of the Penal Code, which deals with cheating. If convicted, he faces potential penalties including up to five years in prison, a fine, or both.
In the court session, Halim pleaded not guilty to the charges. The case centers on accusations that he falsified a document, which led to his predecessor, Datuk Baharin Abdul Hamid, mistakenly issuing an exemption letter to the shipping companies involved. This document, allegedly dated October 27, 2020, falsely claimed that the transport minister had authorized the exemption when no such approval had been granted.
The court has set Halim’s bail at RM20,000, requiring one surety. Additional conditions include monthly reporting to the Malaysian Anti-Corruption Commission (MACC) office in Selangor, surrendering his passport, and refraining from influencing or intimidating witnesses.
This development has sparked significant attention and scrutiny, highlighting the importance of adherence to procedural norms and transparency within Malaysia's maritime regulatory framework.
