Arsit was charged under Section 302 of the Penal Code, which carries the death penalty, upon conviction.
Nur Syamimi identified all the exhibits tendered in court on Friday.
During cross-examination by assigned counsel Mohd Ari Nadzrah Abd Rahman, Nur Syamimi agreed with Mohd Ari that the white cloth was found near the leg of Muhammad Hanafiee’s body.
When asked by Mohd Ari the distance between the white cloth and Muhammad Hanafiee’s body, Nur Syamimi said she was not sure.
To a question, Nur Syamimi said she went to the scene to check by herself the piece of white cloth found near Muhammad Hanafiee’s body.
She also agreed with Mohd Ari that she wrote that the white cloth was found on a tree near Muhammad Hanafiee’s body.
According to Nur Syamimi, she went to the crime scene and recorded everything done by the forensic team.
Meanwhile, Sergeant Major Yusnija Rikasah said her role in the case was to take picture of the exhibits in the crime scene as instructed by ASP Jakariya.
Yusnija informed the court that she had prepared about seven sets of the exhibits’ pictures taken on May 28, 2019. She said there were 74 photos, including that of police placing crime scene tapes where the body of Muhammad Hanafiee was found.
To a question, Yusnija testified that among the photos were those of the suspect being led police to where the body was dumped, suspect’s photos, photos on seizure of exhibits from the suspect’s house, suspect pointing to a car at the roadside of Jalan Marabahai and photos of a car used by the driver.
She said that these photos were taken between May 28 and 29, 2019 except the photos of the suspect pointing to a car at the roadside of Jalan Marabahai were snapped on July 2, 2020.
Mohd Ari raised objections twice on the tendering of several photos in court on the grounds that the photos taken were not in accordance to Section 90A of the Evidence Act 1950.
He argued that those photos did not have declaration certificates as per Section 90A of the said Act.
However, the prosecution submitted that the witness was the one who took those photos, including taking out the photos from a camera and printed them.
The court overruled both the objections raised by Mohd Ari.
To another question, the witness testified that the photos which she did not prepare declaration certificates were taken using a digital camera and she also printed the photos.
During cross-examination, Yusnija agreed with Mohd Ari to a suggestion that she did not prepare declaration certificates for several photos because at that time she was assigned to take those photos and was only an assistant.
Deputy Prosecutor Azreen Yas Mohamad Ramli together with DPP Rozana Abdul Hadi and DPP Siti Hajar Mazlan prosecuted.
So far about 15 witnesses had been called. The trial will resume from July 26-28.
