A-GC - Prosecutors drop appeal against Rosmah’s acquittal, citing no prospect of success

THE prosecution has withdrawn its appeal against Datin Seri Rosmah Mansor’s acquittal on RM7 million money-laundering charges after concluding that there was no realistic chance of overturning the High Court’s decision.

In a statement, the Attorney-General’s Chambers (A-GC) said the move followed a full review of the High Court’s written judgment and the Record of Appeal.

“A-GC decided not to proceed with the appeal to the Court of Appeal after being satisfied that there was no reasonable prospect of success if the appeal were to continue,” it said.

“Among the factors considered was that the prosecution would be unable to prove the case beyond reasonable doubt, as key witnesses have died or can no longer be traced. In such circumstances, the predicate offence against the accused also cannot be proven.”

A-GC added that, given these constraints, the prosecution would not have been able to meet the standard of proof required in a criminal trial.

It emphasised that all relevant factual and legal issues had been examined before the decision was made.

“This Chamber emphasises that all key aspects of the case, including issues of fact and law, were reviewed before the decision not to proceed with the appeal was made.”

It also clarified that the withdrawal has no bearing on Rosmah’s other court matters, including her corruption conviction linked to the hybrid solar schools project.

“The corruption case involving the accused, relating to the hybrid solar project, continues and is currently before the Court of Appeal.

“She was sentenced to 10 years’ imprisonment and a RM970 million fine, but the execution of the sentence has been stayed pending the outcome of her appeal at the Court of Appeal.”

Reports earlier this week confirmed the withdrawal. A letter from the Court of Appeal registrar’s office dated 11 December stated that the A-GC had filed a notice of withdrawal on 9 December.

Following this, case management set for 22 December was vacated, and the appeal terminated under Order 73 of the Court of Appeal Rules 1994. - December 12, 2025
