Alec Baldwin’s high-profile trial is now under way in a courthouse in Santa Fe – almost three years after cinematographer Halyna Hutchin was killed in a tragic shooting while filming Western movie Rust.
During a rehearsal of a shooting scene, a prop gun Baldwin was holding went off, striking and killing Hutchins and injuring director Joel Souza.
Baldwin is charged with involuntary manslaughter and faces 18 months in prison.
On Wednesday, jurors heard opening statements with prosecutors saying that the Hollywood star skipped safety checks and recklessly handled a revolver prior to the fatal incident.
Baldwin “played make believe with a real gun and violated the cardinal rules of firearm safety,” special prosecutor Erlinda Ocampo Johnson said.
But defense attorney Alex Spiro said “these cardinal rules, they’re not cardinal rules on a movie set.”
As the first witnesses took the stand, prosecutors played the fraught 911 call in the aftermath of the shooting and graphic bodycam capturing the frantic efforts of first responders to save Hutchins. In the courtroom, Baldwin looked at the screen somberly as the video played.
Movie’s armorer Hannah Gutierrez-Reed has already been convicted of involuntary manslaughter and sentenced to 18 months in prison.

Alec Baldwin trial spectators flood New Mexico town

Spectators crowded outside a Santa Fe courthouse this week for the start of Alec Baldwin’s high-profile trial.
While many were local, several others had driven from out of town to witness the spectacle.
Janelle Rogers, an Albuquerque resident who once appeared on “Better Call Saul,” held signs with a friend that read: “Justice for Halyna” on one side and “Safety on set! Is a must! No excuses!!” on the other side.
She criticized the film industry, saying, “There is no safety on set.”
“Safety is a must on set regardless of who you are or where you are,” Rogers told the New York Post.
“Halyna Hutchins shouldn’t have died.”

“I blame a lot of people for her death. It’s multiple people. Just because you’re an actor or not a producer, doesn’t mean you’re exempt,” Rogers said, adding that she believes his wife being at the trial is a publicity stunt promoting their new reality show.
A Rio Rancher resident drove an hour from her home to attend the trial. She had followed the trial of armorer Hannah Gutierrez-Reed — who was sentenced to 18 months behind bars after she was found guilty of involuntary manslaughter in March.
“I watched the Gutierrez case,” Jarrell said. “[I’m] super excited it was in my home state. [I] drove about an hour to be here.”
She is advocating for stricter gun safety laws and justice for Hutchins.

Testimony resumes today in Alec Baldwin’s high-profile trial in Santa Fe, New Mexico.
Court is expected to start at 10:30am ET.
On Wednesday, Attorney Gloria Allred sat in the front row of the courtroom audience, a reminder of Baldwin’s other legal difficulties.

Allred is representing “Rust” script supervisor Mamie Mitchell and Hutchins’ sister and parents in a civil lawsuit against Baldwin and other producers.
Allred said that from her observations in court, the jury appeared to be riveted by testimony and evidence including the police lapel camera video.

The prosecution told the jury during opening statements that Alec Baldwin routinely failed to do safety checks with the armorer on the set of “Rust.”
Special prosecutor Erlinda Ocampo Johnson said Baldwin was filmed during his required gun safety training “running around, shooting his gun.”
She also said he “didn’t want to offend” armorer Hannah Gutierrez-Reed by doing the safety checks that were required every time he was handed a gun.
“You will learn that one of the rounds in that revolver was a real round, and the evidence will show that Ms. Gutierrez then handed the gun to the defendant,” Johnson said.
“And what you will learn is that, once again, the defendant failed to do a gun safety check with this armorer.”

Defense attorney Alex Spiro said in opening statements Wednesday that the shooting of Hutchins was an “unspeakable tragedy but Alec Baldwin committed no crime.”
“You have to step back and remember what they were doing on a movie set. Movies and magic have always been closely associated... all over this country for many decades,” he said.
Spiro shifted attention to how a live bullet ever made its way to the Rust movie set, insisting there was no evidence that Baldwin had anything to do with the bullet going into the gun.
“He was an actor, acting, playing the role of Harlan Rust,” he said. “An actor, playing a character, can act in ways that are lethal that just aren’t lethal on a movie set. These cardinal rules, they’re not cardinal rules on a movie set.”
What happened to movie weapons armorer Hannah Gutierrez-Reed?

Hannah Gutierrez-Reed, a movie weapons armorer, received the maximum sentence of 18 months in jail for involuntary manslaughter in the fatal shooting of a cinematographer by Alec Baldwin on a Western movie set.
A New Mexico judge found that Gutierrez-Reed’s recklessness amounted to a serious violent offense, while noting few indications of genuine remorse from the defendant since her conviction in March.
Prosecutors blame Gutierrez-Reed for unwittingly bringing live ammunition onto the set of “Rust,” where it was expressly prohibited, and for failing to follow basic gun-safety protocols .

Who is on the jury in the Alec Baldwin trial?
03:00
Andrea Cavallier
Prosecutors and defense attorneys selected 16 jurors — 11 women and five men — on Tuesday, seating a jury from a region with strong currents of gun ownership and safety informed by backcountry hunting.
Four of the jurors will be deemed alternates while the other 12 deliberate once they get the case.
The shooting death of cinematographer Halyna Hutchins, a 42-year-old rising star in her craft, nearly three years ago sent shock waves through the film industry and led to one felony charge against Baldwin that could result in up to 18 months in prison.
Baldwin attorney Alex Spiro probed prospective jurors on Tuesday for strong opinions about gun safety and asked whether a person must entirely take responsibility for whether a gun is loaded or may “rely on experts, does anybody have a problem with that?”
Most who answered said they always treat a gun as if it were loaded.

Special prosecutor Erlinda Ocampo Johnson said in her opening statement that before the shooting, Alec Baldwin skipped safety checks and recklessly handled a revolver.
“The evidence will show that someone who played make believe with a real gun and violated the cardinal rules of firearm safety is the defendant, Alexander Baldwin,”Johnson said.
But defense attorney Alex Spiro replied that “these cardinal rules, they’re not cardinal rules on a movie set.”
“On a movie set, safety has to occur before a gun is placed in an actor’s hand,” Spiro told the jury.
He said the shooting of cinematographer Halyna Hutchins was an “unspeakable tragedy” but that “ Alec Baldwin committed no crime; he was an actor, acting.”
He said Baldwin did exactly what actors always do on the set of the film “Rust,” where Hutchins was killed in October, 2021.
“I don’t have to tell you any more about this, because you’ve all seen gunfights in movies,” Spiro said.

Alec Baldwin, along with a Santa Fe court, watched footage of Halyna Hutchins’s final moments.
When authorities arrived on the scene, body cam footage showed how Hutchins moved her head from side to side while paramedics tried to stabilize her.
“Deep breath, Halyna. Deep breath,” a paramedic told Hutchins in the video.
Joel Souza, the director who survived his injuries after being shot could be heard screaming.
Baldwin remained expressionless as he watched and several jurors took notes.
His brother Stephen watched, but their sister Beth Keuchler and Baldwin’s wife did not.

The second witness to take the stand on Wednesday was Timoteo Benavidez, a retired lieutenant with the Santa Fe Sheriff’s Office.
The prosecution’s questioning attempted to establish a chain of custody for the gun.
Benavidez told the court that he took the gun from the armorer and made sure there were no more rounds in it before placing it in the front seat of his patrol car – which he described as the “most secure” location he had at the time. He also took ammunition from the armorer’s cart and put it in his car.

Defense says Baldwin was assured his gun was ‘cold’

Spiro told jurors that the cast and crew were assured multiple times that Baldwin’s gun was “cold.”
A cold gun doesn’t mean no live bullets, he explains to the jury. “It means that you don’t even have the blanks or dummies in it. It means it is inert and can do no harm. They can’t hurt anyone,” he says.
Spiro also described the atmosphere as being calm on the set that day.
“No one had any idea that this venomous, toxic element had been inserted into this magic they were creating, but it did,” he said. “It entered that place. It killed an amazing person, it wounded another, and it changed lives forever.”
He then explained the roles of the people on set, placing the blame on armorer Hannah Gutierrez-Reed, and David Hall, the set’s first assistant director.
“Everybody on a movie set has a role. The armorer armors. The director directs. The actor acts,” he said. “They work in harmony, but they have a division of responsibility.”

Baldwin pulled the trigger, prosecution says

Johnson tells the jury that they will see video footage during the trial of Baldwin using the gun on set.
“You’ll see the video footage of the multiple occasions during which the defendant used this firearm on the set, and each time he fired it, it was working just fine,” Johnson said.
“And in fact, you’ll hear evidence that the defendant himself admitted in December of 2021 that this gun didn’t have any mechanical problems.”
This comes after Baldwin stated that he did not pull the trigger the day Hutchins was shot.
Johnson also said the firearm was repeatedly tested by a forensic expert at the FBI, which determined that the gun had no defects and was in working order.

Prosecutors say they’ll present evidence that Baldwin went ‘off script’
Wednesday 10 July 2024 15:45
Andrea Cavallier
Prosecutors say they’ll present evidence that Baldwin went “off script” and failed to follow basic industry standards for firearms safety when he pointed the firearm at Hutchins on October 21, 2021.
“At the end of the day, the prosecutor’s main theory is that this was a gun involved, and Baldwin had a gun in his hand, and it doesn’t matter if it’s a film set or hunting safety class, you’re responsible for what comes out of the end of the barrel,” said John Day, a Santa Fe-based defense attorney and former prosecutor.
Testimony at trial will delve into shortcomings in a final safety check of the gun before Baldwin began rehearsing with it, as well as the mechanics of the weapon and whether it could have fired without a trigger pull. The live bullet that killed Hutchins also wounded director Joel Souza.

A look at Alec Baldwin’s career
Tuesday 9 July 2024 20:45
Andrea Cavallier
Before the horrific 2021 shooting of cinematographer Halyna Hutchins on the set of “Rust” put Alec Baldwin’s career in question, he took on, and sent up, a wide spectrum of variations of masculinity.
He has shifted from playing heroes to scoundrels to thugs to gentle father figures to office alpha males to a “ Boss Baby.” He went from star leading man to bit player to scene stealer, at times going years without a major role in a hit film or show.
But he has remained a household name for nearly 35 years, largely on the strength of his real-life personality: as an outspoken liberal, occasional hothead, talk-show guest, podcast host, game show host, and the king of all “Saturday Night Live” hosts.
Here’s a look at Baldwin's career in and out of Hollywood:

Who is Alec Baldwin?
Tuesday 9 July 2024 20:15
Andrea Cavallier
Baldwin, 66, emerged as a major movie star in the late 1980s and early ‘90s through films like “Beetlejuice” and “The Hunt for Red October,” and has remained a household name ever since.
He would move on to memorable supporting roles in films including 2003’s “The Cooler,” which got him an Oscar nomination. Comedy dominated his later career as he won two Emmys for playing network executive Jack Donaghy on six seasons of “30 Rock,” and won a third for playing Donald Trump on “Saturday Night Live.”
He has also played the role of outsized public personality, as a cherished talk-show guest, a sought-after liberal, and at times as a man unable to control his outbursts of anger, which have brought public embarrassment and a previous run-in with the law much more minor than the current one.
Baldwin is the eldest of six children — five of them actors — from Massapequa, New York, who has lived in New York City for most of his adult life.
He has an adult daughter, Ireland Baldwin, with his first wife Kim Basinger, and seven small children with his second wife, Hilaria Baldwin.
How much jail time could Alec Baldwin face if convicted?

On the day of the shooting, Baldwin was rehearsing a scene in which he was required to draw his weapon and aim it toward the camera.
Ms Gutierrez-Reed had prepared a trio of guns for use in the scene, including two guns that could not fire rounds, and a fully-operational replica of a Colt 45 revolver.
The armourer reportedly checked the weapons before placing them on a cart and making them available to Baldwin, according to court documents.
While discussing the scene, Baldwin was showing Hutchins, camera operator Reid Russell, and the film’s director, Joel Souza, how he intended to draw the firearm.

“So, I guess I’m gonna take this out, pull it, and go, ‘Bang!’” Baldwin reportedly said, according to a report by the LA Times.
At some point during his draw and explanation, the revolver fired. The bullet struck Hutchins in the chest, exited her body, and then hit Mr Souza, who was behind her.
First responders transported Hutchins to a hospital in Albuquerque, New Mexico, close to where the film was being shot. She was pronounced dead later that same day. Mr Souza survived.
It was later discovered that a live round had been loaded into the pistol Baldwin used on set that day.
