Prime Minister Anwar Ibrahim’s recent remarks urging Tun Dr Mahathir Mohamad’s sons to return their vast fortunes—unless they can clearly explain how they acquired them—have reignited public discourse on Malaysia’s long-standing problem with elite corruption.

In an interview with Indonesian journalist Najwa Shihab, Anwar did not mince words. Highlighting the staggering wealth declared by Mahathir’s sons—RM1 billion by Tan Sri Mokhzani Mahathir and RM246.2 million by Mirzan Mahathir—Anwar questioned how such sums were amassed. “You must pay it back, unless you can clearly explain where the funds came from,” he asserted.

While the prime minister has left the investigation to the Malaysian Anti-Corruption Commission (MACC), former Klang MP Charles Santiago believes this moment is ripe for systemic reform. He has called on the government to introduce an Unexplained Wealth Order (UWO), a legal instrument that could permanently shift the way Malaysia deals with illicit enrichment.

What Is an Unexplained Wealth Order?

A UWO is a powerful legal tool used in countries like the United Kingdom to tackle corruption and financial crime. It allows enforcement agencies to compel individuals to explain how they acquired assets that appear vastly disproportionate to their declared income, even if no criminal charges have been filed.

Unlike current Malaysian laws under the MACC Act or the Anti-Money Laundering Act, which require authorities to first open an investigation and prove wrongdoing before assets can be frozen or seized, a UWO shifts the burden of proof. If a person cannot adequately justify the source of their wealth, the state can confiscate it.

This approach is preemptive rather than reactive, targeting suspicious wealth before it gets laundered or hidden—cutting short the often years-long court battles that rarely result in meaningful recovery.

Why It’s a Game-Changer

Charles Santiago highlighted that between 2018 and 2023, Malaysia lost a staggering RM277 billion to fraud, procurement abuse, and illicit financial flows—an average of RM55 billion per year. That’s money that could have built schools, hospitals, or social safety nets. And yet, those implicated in corruption often manage to slip through the cracks of a sluggish legal system.

In the UK, UWOs have already yielded results, with £62.9 million (RM390 million) recovered in just one year through the mechanism. Santiago believes Malaysia can do the same. “Recover stolen wealth without dragging cases for decades in court,” he said in a series of posts on X.

More importantly, Santiago warns against making the issue about political vendettas. “Unexplained wealth shouldn’t depend on who’s in power,” he said. “Ordinary Malaysians are forced to prove their income when applying for aid or a housing loan. Why shouldn’t billionaires be held to the same standard?”

Justice Without Politics

The concept of UWO introduces legal fairness and institutional integrity. It treats corruption as a systemic issue, not a political weapon. With a UWO, Malaysia wouldn’t need to wait for exposés, political scandals, or whistleblowers to act. It would be the law itself that raises the question: How did you afford that?

By creating a clear legal trigger that requires the wealthy to explain the origins of their riches, UWOs could help depoliticise the fight against corruption and make enforcement consistent, regardless of who is in power.

Prime Minister Anwar may have taken a bold stance by calling out the Mahathir family. But as Charles Santiago suggests, if Malaysia truly wants reform “not just on paper or in regulation, but reform in action,” then it’s time to go one step further—and bring in the Unexplained Wealth Order.
