
THE Malaysian Court of Appeal has established a comprehensive set of 17 guidelines that trial judges must follow when a defendant enters a guilty plea, covering cases ranging from long-term imprisonment to the death penalty.
Delivering the judgment, Justice Datuk Zaini Mazlan stressed that court records must clearly document compliance with each step in the guidelines to ensure the integrity and transparency of the judicial process.
“The failure to adhere to these guidelines may undermine the validity of a defendant’s guilty plea and, consequently, any resulting conviction,” he said while dismissing an appeal by a man convicted for trafficking approximately one kilogram of cannabis.
The case involved Teh Geok Chin, 47, who was sentenced by the High Court in Johor Bahru in October 2023 to 30 years in prison and 12 strokes of the cane after pleading guilty to the charge at a residential apartment four years prior.
Justice Zaini noted that Section 305 of the Criminal Procedure Code restricts an appellant who has pleaded guilty from challenging the conviction, allowing appeals solely on the sentence imposed. He affirmed that the High Court fully complied with Section 173(b) of the Code, including reading and explaining the charge to the defendant in her preferred language, Mandarin.
“The defendant also understood the implications of her guilty plea,” he added, confirming that the prosecution evidence was presented and acknowledged, and the defendant accepted the facts after the charge was read. Sentencing followed submissions by the defence counsel for mitigation.
Justice Zaini explained that following the July 2023 amendments to sentencing laws, the High Court had only two options: impose the death penalty or a fixed term of 30 years in prison accompanied by 12 strokes of the cane. “Appeals against the sentence cannot be entertained, as it represents the statutory minimum,” he said.
The three-judge panel, which included Chief Judge of Malaya Datuk Hashim Hamzah and Justice Datuk Azmi Ariffin, underscored that strict adherence to these procedures is essential to safeguard the legitimacy of guilty pleas in the Malaysian criminal justice system. - January 2, 2026
