
Kota Kinabalu: A 37-year-old undocumented man was jailed five years and ordered given a stroke of the cane by the Sessions Court for armed robbery.
Junaidi Otoh pleaded guilty before Sessions Court Judge Noor Hafizah Mohd Salim to robbing Dante Pairan of two smartphones, wallet containing an identity card and driving licence, RM70 cash and RM227 belonging to the shop.
Junaidi committed the robbery at 11am on Jan 14 at the Sumundu Mini Mart Grocery Store at Jalan Kibabaig, Penampang.
Junaidi was jointly charged with another accused, Mohd Zulfadhli Sunar, who pleaded not guilty to the charge and another who is still at large under Section 394/34 of the Penal Code which carries a jail term of up to 20 years and whipping, on conviction.

Read more Deputy Public Prosecutor DK Afiqah Alya told the court that Dante, who works as a cashier at the grocery store, was approached by an unknown man who pointed a knife at Dante and then demanded he hand over the money.
Afiqah said Dante panicked and opening the petty cash drawer.
The man grabbed the money inside the drawer and also took wallet and two mobile phones placed on the table.
The suspect then fled with two other men who were standing guard in front of the store.
Afiqah said the three men were not wearing masks and Dante was able to identify Junaidi during the identification line-up conducted by police.
Junaidi was the one who pointed the knife at Dante. During mitigation, Junaidi requested leniency as he has a child to take care of and promises never to enter the State illegally.
However, Afiqah applied for a deterrent sentence as armed robbery is a serious crime that should be severely dealt with.
The court ordered Junaidi to serve the sentence from the date of his arrest.
