
Kota Kinabalu: A 42-year-old trader was charged in the Magistrate’s Court here Thursday with assault and criminal intimidation.
Lim Yoong Fei, who appeared before Magistrate Wan Farrah Farriza Wan Ghazali, pleaded not guilty to the charges against him.
On the first count, Lim allegedly voluntarily hurt his 38-year-old wife on Aug 19, this year, at 4.30pm, at a restaurant in Borneon Centre, Jalan Kolam near here.
Lim was charged under Section 323 read with Section 326A of the Penal Code.
Section 323 carries a jail term of up to one year or a fine or both, on conviction, while Section 326A enhances punishment for causing hurt to a spouse, former spouse, child, or incapacitated adult, making the punishment twice the maximum term for the original offence under Sections 323, 324, 325, 326, 334 or 335.
On his second charge, Lim was accused of threatening to injure a 14-year-old boy at the same place and time.
The charge is framed under Section 506 of the Penal Code, which carries a jail term of up to seven years or a fine or both, on conviction.
The court fixed Oct 16 and Oct 22 for mention of the first and second cases, respectively.
Lim was offered bail at RM3,000 in two sureties on the first charge and RM2,000 also in two sureties on the second charge.
Meanwhile, Lim was also charged with taking amphetamine and syabu.
He allegedly committed the offence on Aug 20, at 3.10pm at the Police Station here.
Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years in jail, on conviction.
The court fixed Oct 30 for mention and released the accused on a bail of RM1,200.
