TAWAU: A former licensed ex-convict (OBB) who crashed into the back of a van at the end of last year while driving under the influence of alcohol was jailed a month and fined RM10,000 or three months’ jail.

Roslan Lenter, 41, pleaded guilty before Magistrate Don Stiwin Malanjum, who also ordered Roslan’s driving licence to be disqualified for two years.

AdvertisementHe was charged under Section 45A(1) of the Road Transport Act (APJ) 1987 (Act 333/87), which carries a penalty of imprisonment for up to two years and a fine of up to RM30,000, if convicted.

Based on the case facts, a Toyota Hiace driven by a 36-year-old man was rear-ended by the Viva driven by Roslan at the Hilltop roundabout while heading towards Tanjung Batu from Kg Sri Menanti.

A check on past criminal records revealed that Roslan was a former OBB under the supervision and monitoring of the Tawau District Parole and Community Services Office, with his license expiring on Feb 9, 2023.

AdvertisementIn mitigation, Roslan, who was unrepresented, requested a lighter fine as he was unemployed and had no income.

He also admitted to drinking alcohol at a Christmas celebration at a friend’s house when questioned by the magistrate about where he bought the alcoholic drinks (despite not being employed and having no income).

AdvertisementTraffic Prosecuting Officer ASP Joan Lee urged the court to impose a heavy and appropriate sentence on Roslan due to public interest, as his actions of driving under the influence of alcohol were irresponsible and dangerous to himself and others.
