Controversial blogger Raja Petra Kamarudin, who has been residing in the UK for the past 15 years, has dismissed the notion that the Malaysian government could successfully seek his extradition from the UK.
Raja Petra maintained that the Malaysian government would require a court order from the UK and approval from the British home office before he could be arrested and extradited. In addition, he emphasized that Malaysia must establish dual criminality, meaning that the alleged offenses committed in Malaysia must also be considered crimes in the UK. Raja Petra specifically mentioned that the charges against him involved attempting to topple the government, sedition, and criminal defamation.
However, he pointed out that sedition and defamation are no longer considered crimes in the UK since they were abolished in 2009. Nonetheless, sedition and defamation remain offenses in Malaysia, as stipulated by the Sedition Act 1948 and Sections 499 to 502 of the Penal Code, respectively. Raja Petra argued that the UK court would not entertain requests for his extradition, as evidenced by the fact that the government failed to extradite him back in 2009 for the same offenses.
Raja Petra's decision to move to the UK stemmed from being charged with sedition in 2009 due to an open letter he wrote regarding a constitutional crisis in Perak at the time. Recently, it was reported that Raja Petra was being sought by the Malaysian authorities in relation to claims that attempts were being made to overthrow the ruling government through the so-called "Dubai Move.
"The Inspector-General of Police, Razarudin Husain, stated that the police were working with the Attorney-General's Chambers (AGC) to facilitate this process. In his YouTube video, Raja Petra expressed his willingness to provide a statement concerning the "Dubai Move" as long as the Malaysian authorities covered his expenses. He welcomed communication from Bukit Aman or the AGC in that regard.
In summary, Raja Petra Kamarudin has expressed his skepticism regarding the government's ability to pursue his extradition from the UK. He cited the abolishment of sedition and defamation as criminal offenses in the UK and stressed the requirement for dual criminality. Raja Petra has expressed his willingness to cooperate with the Malaysian authorities but expects his expenses to be covered.
