Halle Berry’s ex-husband, Olivier Martinez, has reportedly accused her of physically abusing their 12-year-old son, Maceo, with a court granting a temporary restraining order against the X-Men actor.
Berry, 60, who is best known for starring as Storm in the superhero trilogy as well as Bond film Die Another Day, was married to French actor Martinez from 2013 until 2016, with the couple welcoming son Maceo the same year they wed. Their split wasn’t finalised until 2023 after a lengthy divorce battle.
On Thursday 1 October, Martinez was granted a temporary restraining order against Berry, covering both himself and Maceo, according to court documents seen by People.
In his petition to the court, Martinez alleged that Berry caused him “emotional and mental distress due to physical abuse of our minor child, Maceo”, the publication reported. He also claimed that the X-Men actor “grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now? Who is dominant?’” during the alleged incident.
Martinez also reportedly alleged that Berry had engaged in “instances of abuse over the course of the last few years”, which included “additional physical attacks against our son, as well as verbal and emotional abuse from Petitioner to me”.
The Independent has contacted Berry and Martinez for comment.
Berry’s lawyer Marina Beck said in a statement that Martinez’s filing is “entirely meritless and deliberately misleading”.
“Fortunately, Halle is used to this kind of outrageous conduct from Mr Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs,” she told the publication.
The judge reportedly modified the hours of Berry’s visitation with her son, limiting her time with him to Mondays and Tuesdays between 10am and 8pm, and Saturday and Sundays from 10am until 8pm. However, the judge denied Martinez’s request for Berry’s sobriety to be monitored, saying that he provided “insufficient information” on that front.
Martinez’s lawyer Patrick Baghdaserians told the publication that Martinez’s “paramount concern is the health, welfare and the safety of the minor child”.
“The second concern would be for mother to get the appropriate help that she needs to address her issues so she can better herself, which would in turn help the minor child moving forward,” he said.
Berry and Martinez reached a child support agreement over Maceo in 2023, eight years after announcing their divorce. They agreed to share legal and physical custody, while Berry, who also shares a daughter, 18, with her ex-partner Gabriel Aubry, agreed to pay Martinez $8,000 a month in child support and an additional 4.3 per cent of any income she makes above $2m.
A hearing on Berry’s restraining order will take place on October 16.
