
SANDAKAN: A government servant was charged with giving a RM7,000 bribe to a shop owner so that the owner will withdraw a police report on a robbery case two years ago.
Harvey Glen Gerald, 45, pleaded not guilty before Sessions Court Judge Jason Juga on Tuesday.
Harvey is accused of giving the bribe to the man as inducement to withdraw the police report pertaining the gang robbery case against Harvey who could be charged under Section 395 of the Penal Code.
The bribe offence allegedly took place at noon on Oct 30, 2021 in Kg Rampek Beluran, near here.
The offence under Section 16(b)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 and punishable under Section 24 of the same Act which provides for a jail term of up to 20 years and fine of five times of the amount involved or RM10,000, in which is higher, on conviction.
The court released Harvey on bail of RM15,000 with RM2,000 deposited in two local sureties.
Harvey was also ordered to report to MACC’s office twice a month, his passport, if any, to be impounded by the court and warned to not tamper with the prosecution witnesses.
The court set May 18 for mention.
In another case, a woman was discharged and acquitted from 15 charges of cheating, without her defence being called.
Norazura Ahmad was freed from the charges after the court ruled that the prosecution had failed to establish a prima facie case against the accused.
On the first to 15th counts, Norazura was accused of cheating a man by asking money for the use of company activities which were actually for her own use.
The offence allegedly took place between January 2016 and June 2017 in which the man had banked-in money every month into Norazura’s account.
Ten witnesses were called during the hearing.
