Kota Kinabalu: A 34-year-old former chief accountant, who was charged with committing Criminal Breach of Trust involving a sum of RM277,405.25, was ordered to enter his defence to the charge.
Sessions Court Judge Zaini Fisher @ Fisal made the order on Barnabas Aki Justus ruling that the prosecution had established a prima facie case against him and called him to enter his defence against the charge.
The court fixed Sept 22- 24 for Bernabas’ defence.
Barnabas was accused of breaching the trust given to him as Chief accountant of Syarikat Bewonder Holdings Sdn Bhd which entrusted him with the money belonging to the company.
The offence allegedly took place between Dec 4, 2023 and March 14, 2024 at the company premises, here.
The offence under Section 408 of the Penal Code carries a jail of between one and 14 years, and whipping, and fine, on conviction.
The prosecution had called four witnesses at the prosecution stage.

The court ordered Barnabas to be released on an extended court bail.
In another case, a 34-year-old labour charged with raping an underage girl five years ago, was ordered to enter his defence to the charge after the court found that the prosecution had established a prima facie case against him.
The Sessions Court Judge set Sept 19 for Jumat Pilih’s defence.
Jumat allegedly raped a girl, then 15, on Nov 20, 2021, at 4.40pm, in a store room of a premises in Penampang.
The charge is framed under Section 375(g) of the Penal Code.
Five prosecution’s witnesses were called at the prosecution stage.
