Kota Kinabalu: A 24-year-old woman, who committed criminal breach of trust involving a sum of RM48,626.45, was jailed 18 months.

Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to Nur Atikah Omping who changed her plea and pleaded guilty to the charge against her on Monday.

Nur Atikah admitted to breaching the trust given to her as the petty cash admin by Kedai Istana Ayam Tua, with three days of daily sales amounting to RM70,022.40 but she only banked-in RM21,395.95 into the company’s bank account and banked-in the balance of RM48,626.45 into her own account for her own use.

The offence took place at Kedai Istana Ayam Tua in Tuaran between Nov 10 and 12, 2021.

The offence under Section 408 of the Penal Code provides for a jail term of between one and 14 years, with whipping and also liable to a fine, on conviction.

The court ordered Nur Atikah to serve the jail sentence from Monday and her bail to be refunded upon application by the sureties.

During mitigation, Nur Atikah who was not represented asked for a light sentence saying that she was remorseful for her wrongdoing.

However, Deputy Public Prosecutor Dacia Jane Romanus urged the court to impose a deterrent sentence on the grounds that it was a serious offence.

The court heard that on Nov 13, 2021, the company found that the amount of money banked into the company’s account was different from the record of the three days’ daily sales and Nur Atikah was entrusted with the money.

Further investigation revealed that Nur Atikah did not bank-in all the money into the company’s account but into her own account for her own use.

Following a police report, she was arrested for committing the breach of trust.
